ABOUT:Compliance with the Service Contract Act (SCA) should be a top priority for contractors subject to this law. Department of Labor (DOL) prevailing wage law audits and enforcement proceedings are aggressive and on the rise and can result in: · Back pay (up to six years),
· Separate overtime violation penalties,
· Withholding of contract funds, and
· Debarment for three years from all government contracts.
In addition, there is potential for exposure for SCA violations under the Civil False Claims Act.

The SCA regulations are complex and don’t always provide a clear path for compliance efforts, particularly with regard to worker classifications, benefits, and the role of collective bargaining agreements in the process. Federal agencies don’t always perform their role in the regulatory scheme, which can leave contractors vulnerable not only to being tagged with SCA violations, but also to loss of profits on a contract. SCA contractors must ensure that their benefits plans comply with the SCA, and that they are cost effective and meet requirements under the Employee Retirement Income Security Act and the Affordable Care Act.
